We have a voucher from the restaurant La Quercia over € 50,00. This voucher was issued on 21.02.2020 valid until 21.02.2021. We asked if the voucher is still valid. In response, we got no voucher is already charged with the tax office???? We were very disappointed about this answer and left the restaurant without food. In principle, vouchers are valid for three years! If nothing else is on it, a voucher is valid for three years. The deadline shall expire at the end of a calendar year. For example, if the date of purchase was in February 2020, the voucher will not expire exactly three years later in January, but only at the end of 2023. Coupon providers may also set a shorter redeeming period under certain conditions. But there must be comprehensible reasons. For a voucher for a specific performance, such as a ride with the hot air balloon or a three-course menu, a shorter period may be justified. Finally, wages and food costs can be considerably more expensive from one year to another. For a value voucher over a certain amount, however, it is not good to justify why this should be valid for less than three years. In general: The deadline must not be too short. Customers must have a realistic chance to redeem the voucher. A shorter deadline must also be on the voucher or in the General Terms and Conditions. For example, in two judgments of 17.01.2008 (Az.: 29 U 3193/07) and 14.04.2011 (Az.: 29 U 4761/10), the Oberlandesgericht Munich decided that a period of one year is too short and therefore ineffective. In such cases, the statutory limitation period applies. So absolute caution when buying vouchers in this restaurant!
